| 50% minimum deposit required on special orders. |

| Returns must be made within ten days, accompanied
by a receipt and are subject to a restocking charge. |

| Special orders or materials cut to size are not
returnable. |
|
| No quantity or size discrepancy will be allowed
unless ALL METALS is notified within five days of shipment receipt. |
|
| A service charge of 1 1/2% per month or a minimum
charge of $5.00 is assessed on all credit amounts not paid in accordance with
ALL METALS terms. |
|
| Customer hereby expressly agrees to pay all costs
and expenses of collection, including but not limited to, attorney's fees and
court costs. |
|
| There are no implied warranties of
merchantability of fitness for purpose. Employees of ALL METALS are not
authorized to warrant the suitability of any goods for any particular use of
application. Final determination of the suitability of the goods purchased is
the customer's sole responsibility. |
|
| Processing metal by rolling, bending or
any other method may cause the dimensions of the original size to
change. ALL METALS will not be liable for any deformation caused
by such processing, and further ALL METALS will not be liable for
material failure caused by such processing.
|
|
| In no event shall ALL METALS be liable for
incidental or consequential damages or for any other loss or damage, including
lost profits, even if ALL METALS, has been advised of the possibility of such
damages. |
|
| Liability is limited to, at the option of ALL
METALS, replacement of defective or nonconforming goods or the refund of the
purchase price upon return of the goods to ALL METALS. |
|
| Title shall pass to the customer upon delivery of
the goods to the common carrier. Any claim for damages will be with the common
carrier. |
|
| Delivery dates are approximate. ALL METALS shall
not be responsible for delays in delivery or performance due to causes beyond
their control, including, but not limited to, acts of nature, acts of buyer,
strikes or other labor disturbances, inability to obtain fuel, material or parts,
delays in transportation, repairs to equipment, fires or accidents. Acceptance
of goods upon delivery shall constitute a waiver by buyer of any claim damages
on account of delays in delivery or performance. |

| The terms and conditions of items sold as "surplus"
are "as is, where is with all faults lying." |
|
| Caution: ALL METALS assistance in loading
and/or
tying down your merchandise is not a representation that your load is safely
loaded and/or tied down. Any damage caused to or by your merchandise is solely
your responsibility. |
|
| Caution: Processing of plastic, ferrous and
non-ferrous metals may present a respiratory or skin hazard. Please request
Material Safety Data Sheets for further information. |
|
| ALL METALS objects to any inconsistent or
additional terms or conditions that may be contained in your purchase order,
confirmation or other document. |
